On October 26, 1999, PPL Utilities offered to sell capacity and/or energy to PPL EnergyPlus Co. LLC, an affiliate of PPL that is a licensed electric generation supplier (EGS) in Pennsylvania, Maine, Montana, New Jersey and Delaware authorized to sell electric energy to retail customers. The offer provides that PPL EnergyPlus Co. must use the capacity and/or energy to supply PPL EnergyPlus Co.'s competitively-acquired retail load located in the PJM Control Area within New Jersey and Delaware. As the terms and conditions below describe, the offer applies to sales of capacity and/or energy for delivery no earlier than November 1, 1999 and no later than December 31, 1999. The terms and conditions of the offer, including pricing, are set forth in the proposed Agreement. The offer is available to EGSs licensed in New Jersey and Delaware.
